TUPE (09): application to property transactions
This note considers the impact of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) (TUPE) on property transactions. The note provides an overview of how TUPE affects employers (who, in this context, may be landlords, tenants or facilities service providers) and employees and describes the types of property transactions where TUPE may apply. Drafting issues for each specific property transaction are also discussed.
