Transfers: clauses for TR1 (residential freehold or leasehold property)
These clauses provide wording for drafting key sections of the Land Registry prescribed form of transfer of whole (Form TR1) for property transactions in England and Wales. These clauses address modifications to the covenants for title implied under the Law of Property (Miscellaneous Provisions) Act 1994 (LPMPA 1994), including variations to the title guarantee provided by the transferor, and options for scenarios where no title guarantee is given. Additionally, these clauses offer detailed drafting options for panel 11 of Form TR1, covering definitions such as "Charge" and "Lease", the matters to which the disposition is subject, the exclusion of new implied easements under section 62 of the Law of Property Act 1925, and the inclusion of indemnity covenants to address ongoing transferor liabilities, particularly relevant for leasehold properties. These clauses are designed for transfers of whole residential properties with vacant possession.
