Statement of truth to support application to Land Registry on surrender of lease by operation of law
A standard document providing a template statement of truth to support an application to HM Land Registry following the surrender of a lease by operation of law. An application may be made to close the leasehold title or cancel a notice of the lease on the landlord's title when a surrender is inferred from the conduct of the landlord and tenant. In certain circumstances, Land Registry Practice Guide 26 requires the application to be supported by evidence, such as this statement of truth. This standard document outlines the necessary information and formalities required under rule 215A of the Land Registration Rules 2003 (LRR 2003), serving as an alternative to a statutory declaration. It addresses key details such as the consideration paid for the surrender, how the tenant provided vacant possession, and the return of keys to the landlord. This standard document's drafting notes also explain when a statement of truth or statutory declaration may not be required.
