Sexual harassment policy

by Practical Law Employment

Maintained | England, Scotland, Wales

A Standard document that provides a model sexual harassment policy for employers to adapt for use as part of a staff handbook or as a standalone document. This policy is designed to help employers fulfill their legal duty to take reasonable steps to prevent sexual harassment in the workplace, as required by the Equality Act 2010 (EqA 2010). It sets out a framework for managing and responding to incidents, covering key definitions of sexual harassment, victimization, and third-party harassment from individuals like customers or suppliers. The policy outlines procedures for both informal resolution and formal complaints, detailing the investigation process, potential outcomes and the appeals process. Importantly, this policy addresses the protection of complainants and witnesses from retaliation or victimisation and has been drafted in accordance with guidance from the Equality and Human Rights Commission (EHRC), providing a valuable tool for creating a safe and respectful working environment.
