Settlement agreement (no termination)

A Standard Document providing a short-form settlement agreement for use in England and Wales where there will be no termination of employment, meaning that the employee continues to be employed after a specific complaint has been resolved. This Standard Document is designed for situations where the employment relationship has not fundamentally broken down, allowing parties to settle disputes while maintaining an ongoing working relationship. It sets out the key terms for a binding waiver of claims in return for a compensation payment, and satisfies the necessary statutory requirements under employment legislation such as the Employment Rights Act 1996 and the Equality Act 2010, including the provision of independent legal advice. Optional clauses for confidentiality and implementing development or project management plans, potentially following a workplace mediation, are also provided.
