Retrospective licence for alterations

This standard document is for use where a landlord grants retrospective consent for alterations that a tenant has already carried out at the demised premises in breach of a lease covenant. This licence regularises the tenant's position by formally documenting the landlord's consent after the works have been completed. The standard document addresses the tenant's confirmations regarding the quality of the works and compliance with all relevant legal requirements, including building safety laws such as the Building Safety Act 2022, and the Construction (Design and Management) Regulations 2015 (CDM 2015). It contains provisions relating to insurance, rent review disregards, and the landlord's right to require reinstatement of the property at the end of the term. The standard document also includes clauses extending the tenant covenants in the lease to the altered property and securing the consent of any tenant's guarantor to ensure their obligations remain effective .
