Leases: Clause granting an option to renew a lease
A standard clause for use where a tenant is granted an option to renew a commercial lease. This clause details the conditions under which the tenant may exercise the option, including serving an Option Notice within the designated Option Period. It ensures that the new lease will be granted on terms consistent with the existing lease, subject to necessary variations. The clause emphasises the importance of registration to protect the tenant's equitable interest in the property. It includes provisions for excluding the security of tenure under the Landlord and Tenant Act 1954 (LTA 1954). The clause also addresses the transfer of the landlord's reversion and implications for successor landlords under the Landlord and Tenant (Covenants) Act 1995 (LTCA 1995). Designed to fit seamlessly into standard commercial leases, it can be adapted for other leases, ensuring a fair balance between landlord and tenant interests. Careful consideration of the lease's terms and registration requirements is recommended to avoid issues with enforceability and protection of interests.
