Lease of additional property by reference to an existing lease
A standard document for granting a lease of additional commercial property to a tenant who already has an existing lease with the landlord. Often referred to as a supplemental lease, this standard document streamlines the drafting process by incorporating the terms of the existing lease by reference, which avoids the need to repeat each individual clause. This document creates a separate, new lease for the additional premises, a structure designed to avoid the potential pitfalls of a deemed surrender and regrant of the original tenancy. It includes provisions for varying the terms of the existing lease as they apply to the new property, such as the rent and contractual term, and provides optional clauses addressing a tenant's guarantor, the landlord's right to terminate, registration at HM Land Registry, and the exclusion of security of tenure under the Landlord and Tenant Act 1954 (LTA 1954).
