Jurisdiction: the gateways
This note considers the rules which provide a basis, or "gateway", for the courts in England and Wales to exercise jurisdiction in a particular type of dispute, including the gateways for service out of the jurisdiction with the court's permission in CPR 6.36 and PD 6B 3.1 (as amended by the 149th Practice Direction Update with effect from 1 October 2022), and the rules in CPR 6.33 regarding service out of the jurisdiction without the court's permission. The jurisdictional gateways in the Recast Brussels Regulation ((EU) 1215/2012) (which only applies to proceedings instituted on or before 31 December 2020) are considered, as well as the gateways for determining jurisdiction between the constituent parts of the UK in Schedule 4 to the Civil Jurisdiction and Judgments Act 1982.
